OVERVIEW

The information contained in this document is based on reports filed by State departments and agencies pursuant to Section 396(4) of Public Act 431 of 1984 (The Management and Budget Act). Based on the amounts reported, the State of Michigan paid $29,607,246 for lawsuit judgments and settlements in fiscal year (FY) 1994-95. This represents a decrease of $3,192,743 (9.7%) from the $32,799,989 paid in FY 1993-94. Of the 210 cases that resulted in payments, 67 were judgments totaling $12,103,943, and 143 were settlements totaling $17,503,303.

Table 1 lists total payments by department from FY 1985-86 through FY 1994-95. Table 2 lists judgment amounts, and Table 3 lists settlement amounts. Payments ranged from $13.80 for a Department of Corrections' case to $5,333,941.78 for continuing payments in the Berry v Benton Harbor Area School District desegregation case. Causes of action originated in 47 of Michigan's 83 counties.

Payments by Departments

Seven departments made payments in 186 cases totaling $28,138,413, which represents 95% of all payments made in FY 1994-95. Table 4 lists departments with payments over $1.0 million.

DEPARTMENT OF CORRECTIONS

The Department of Corrections made payments in 88 cases totaling $4,969,224, an increase of 39.8% over the $3,554,111 paid in FY 1993-94 for 69 cases. The largest payment was $980,000 for Murra v Abramajtys in a case in which an employee was sexually assaulted by a prisoner. The lowest payment was $13.80 in White v Cook for a harassment case that the State won; payments, however, were ordered by the court for documents the prisoner requested during discovery. There were 49 cases with payments of less than $10,000. Eleven cases with payments over $100,000 accounted for $3,722,863 (74.9%) of the total amount paid by the Department of Corrections.
 
 

DEPARTMENT OF EDUCATION

The $5,333,941 paid in FY 1994-95 represents continuing payments in the Berry v Benton Harbor Area School District desegregation case. The defendants in that case included the Benton Harbor Area School District, the Coloma School District, the Eau Claire School District, the Berrien County Intermediate School District, the State Board of Education, and the Superintendent of the Michigan Department of Education. The United States District Court for the Western District of Michigan, Southern Division, directed the State of Michigan to pay certain expenses related to the court's desegregation remedy plan detailed in the court's order dated May 1, 1981. Most of the payments relate to maintenance funding to school districts for students who elected to transfer to another school district and transportation costs. State payments for this case have totaled $47.3 million from FY 1980-81 through FY 1994-95.

MICHIGAN JOBS COMMISSION

The Michigan Jobs Commission was created by Executive Order 1993-2 and officially became a State department in February of 1995. The FY 1994-95 payments made in two cases were originally filed against other departments. One case with a payment of $1,801,024 involved the reallocation of 148 vocational rehabilitation counselor positions in the Department of Education.
 
 

DEPARTMENT OF NATURAL RESOURCES

Payments by the Department of Natural Resources totaled $2,005,360 for 14 cases. The largest payment was $991,429 for a case involving the Michigan Underground Storage Tank Financial Assurance Fund. The total payment in this case was actually $6,915,766; however, $5,924,337 of that amount was reported in FY 1993-94.
 
 

DEPARTMENT OF SOCIAL SERVICES

Payments in 19 cases totaled $2,727,681. Payments ranged from $75 for a Freedom of Information Act claim to $670,803.36 for a case involving reclassification of day care workers. Three cases with payments of $600,000 or more accounted for 68.6% of all payments made by the department.
 
 

DEPARTMENT OF STATE POLICE

Payments totaled $1,268,771 for 15 cases. Payments ranged from a $100 settlement for a forced entry claim to $750,000 for a judgment in an assault case.
 
 

DEPARTMENT OF TRANSPORTATION

The Department of Transportation made payments in 47 cases totaling $9,882,412. This represents a decrease in payments of $2,989,145 (23.2%) from the $12,871,557 paid in FY 1993-94 for 87 cases. Payments for highway negligence cases ranged from a $1,500 settlement for damages caused by a manhole depression and lack of warning, to $3,000,000 for a case alleging improper super elevation, inadequate pavement surface, excessive speed limits, and lack of warning signs. Five cases with payments over $500,000 accounted for $7,207,500 (72.9%) of highway negligence payments. Table 5 and Table 6 provide statistics on State highway negligence payments over the last 10 years. From FY 1985-86 through FY 1994-95 the State paid $158.4 million for 762 cases. Annual payments ranged from $7.5 million in FY 1985-96 to $26.7 million in FY 1986-87.
