The bill would amend the Michigan Business Tax Act to extend the deadline for awarding a credit to a firm that constructs and operates a facility for the development and manufacture of photovoltaic energy, photovoltaic systems, or other photovoltaic technology.  This refundable credit was put in place by Public Act 270 of 2008, and is available beginning in the 2009 tax year.  It is based on the capital investment made in a new facility. Currently, the Michigan Economic Growth Authority (MEGA) cannot enter into an agreement for such a credit after November 1, 2008.  House Bill 4523 would extend the deadline to December 31, 2011.

The bill would establish in statute the current practice in which the counties themselves have their audits conducted on an annual basis; in other words, the statute would be updated to reflect current practice.  Among other things, the bill would require a county to obtain an annual audit of its financial records, accounts, and procedures, and allow county officials to retain a certified public accountant to do so.  If a county failed to provide an audit, the state treasurer would either conduct the audit or appoint a CPA to perform one.  The entire cost of the audit would be borne by the counties.

HB 4830 (Miller)

The bill would amend the County Road Law.  That act allows a county with a population of 1.5 million or more that has adopted a charter under Public Act 293 of 1966 (the charter county law) to reorganize the powers and duties otherwise provided by law for a board of county road commissioners.  This reorganization can occur by amendment to the charter. House Bill 4830 would amend the County Road Law to allow this reorganization in a county with a population of 800,000 or more that "is adopting" a charter under PA 293, and would allow the reorganization "within the writing of" the charter.
