The bill (H-1) would the Public Service Commission law, to require a municipally owned electric or natural gas provider to postpone a shut-off of service for up to 21 days if the customer or a member of his or her household were a critical care customer or had a certified medical emergency.

HB 4655 (Wayne Schmidt)

The bill would amend the Public Service Commission (PSC) law, to require a municipally owned electric or natural gas provider to notify the PSC of any shut-off of service that resulted in death or serious injury. A provider would have to give the Commission any relevant information regarding the death or injury, including the procedures followed during the shut-off. Additionally, upon notification or its own motion, the PSC could investigate any shut-off by a provider that resulted in death or serious injury. After completing its investigation, the Commission could refer the matter to the Attorney General for commencement of a civil action under Section 9p.

HB 4656 (Mayes)

The bill would amend the Public Service Commission (PSC) law, to allow the Attorney General, on his or her own motion or upon a referral from the PSC in a case of serious injury or death, or any customer of a municipally owned electric or natural gas utility, to bring a civil action for injunctive relief or imposition of a civil fine against the utility if it failed to meet the applicable requirements of the Act. The bill also would require a municipally owned utility to establish a complaint resolution process for its customers to resolve any allegations of violations that did not result in a death or serious injury.

The bill would amend the Public Service Commission (PSC) law, to require a municipally owned electric or natural gas provider, in the ordinary course of business, to make efforts to identify senior citizen customers (i.e., those who are at least 65 years old).

HB 4673 (Mayes)

The bill would amend the Public Service Commission (PSC) law, to do the following:
-- Prohibit a municipally owned electric utility from shutting off service to eligible customers (certain senior citizen and low-income customers) during the heating season if they applied for heating assistance, entered into a winter protection payment plan, and paid any arrearages in monthly installments.
-- Allow the utility to shut off service to a noncompliant customer after giving a notice containing specified information, including that unless he or she made the payments that were past due within 10 days of the mailing date, the utility could shut off service; and that he or she could petition the utility in accordance with its rules disputing the claim before the proposed shut-off date, or bring an action pursuant to proposed Section 9p.
